Article 12. The Minister of Transport issues a type certification from the specific design type of an aircraft, when an application for such is submitted.
2. The Minister of Transport shall, where an application under the preceding paragraph is submitted, issue a type certificate under the said paragraph if he finds that the type of aircraft in the application complies with the standards of Article 10 paragraph 4.
3. The type certification is established when a type certificate is issued to
the applicant.
4. Prior to issuing a type certificate under paragraph 1, the Minister of Transport shall consult with the Minister of International Trade and Industry.
Article 13. When the holder of a type certificate intends to modify the design of the aircraft mentioned in the type certificate, approval from the Minister of Transport must be acquired prior to any such modification. The same shall apply when the aircraft is of the same type as that type-certificated but, due to an amendment in the standards of Article 10 paragraph 4, no longer complies with the standards of the said paragraph.
2. The Minister of Transport shall, where an application is made under the preceding paragraph, inspect whether the design complies with the standards of Article 10 paragraph 4, and shall approve the design upon asserting that it meets established standards.
3. The provision of paragraph 4 of the preceding Article shall apply where the Minister of Transport grants approval under the preceding paragraph.
Article 13-2. The Ministry of Transport, shall approve the partial modification of the design by any other person who is not the holder of a certificate for aircraft type-certification, when such an application is submitted.
2. The design of the aircraft type under such approval of the provisions of the preceding paragraph is regarded as that type-certified with regard to application of the provisions of Article 10 paragraph 5 or 6.
3. A person granted approval under the provisions of the preceding paragraph shall secure the approval from the Ministry of Transport when he intends to modify previously approved designs. The same shall apply when the standards under Article 10 paragraph 4 is changed and the relevant approved design does not comply with the standards under the said paragraph.
